We will never sell your personal data to anyone.

1. Introduction

Selz.com Pty Ltd., is a company registered in Australia (ABN 29 163 769 837, (Level 29, Chifley Tower, 2 Chifley Square, Sydney NSW 2000, Australia). This Privacy Policy explains how Selz.com Pty Ltd. and its related entities (“we” or "Selz") collect, store, and process personal information (within the meaning or equivalent meaning of the relevant local privacy laws) about: (i) customers/merchants that use Selz products, applications or services (together, the “Services”) (“Merchants”); (ii) buyers that shop at a store using our technology (“Buyers”); (iii) potential customers/merchants that may express an interest in our Services (“Leads”); (iv) individuals visiting a website owned and operated by Selz (“Website Visitors”); and (v) users of Selz’s support services which relate to the live chat and technical support via email provided to Merchants (“Support Users”). This Privacy Policy also describes how we use and protect this information, and your rights in relation to this information. 

We may be required by law to collect certain personal information about you, or as a consequence of any contractual relationship we have with you. Failure to provide this information may prevent or delay the fulfilment of these obligations.

2. Information relating to our Merchants

  1. What information do we collect from Merchants?

    1. At account creation: we collect your name, company name, address, email address and phone number and other information you may provide us about your business. 
    2. When you subscribe for one of our paid plans: we collect your payment/billing information, for example, last four digits of credit card, billing name, billing address, and expiry date. 
    3. When you apply to use our payment gateway Selz Pay: we collect your business name, business ID, business directors, date of birth, bank account information/credit card details including final 4 digits of bank account, and government-issued identification information, such as your Social Security Number or a copy of your government-issued identification. 
    4. When you create a Selz account.
    5. Usage Data: we also collect data about how and when you access your account and the Selz platform, including information about the browser you use, your network connection, your IP address and information about how you browse the Selz interface. 

    We process the personal information above relating to Merchants for the following purposes:

    1. to operate and provide you with our Services including our support services, including managing accounts with us when you use our Service; for identification and authentication purposes; collecting payments from you for using our Services; and providing you with the Selz Pay services.
    2. to improve our Services by gathering information about the usage of certain features we offer as part of our Services and to enable us to develop those features. 
    3. to deal with your enquiries and requests.
    4. to contact you with marketing including through our newsletter and offers relating to our Services and/or to ask you to participate in user research surveys.
    5. to provide you with online advertising.
    6. to prevent and detect against fraud and other malicious use of our Services and to protect your security.
    7. to comply with legal and regulatory obligations to which we are subject and cooperate with regulators and law enforcement bodies.
  2. How is this information collected?

    We collect this information when you sign up for our Services, when you access our Services or otherwise provide us with the information. We may also collect personal information from third parties, such as our service providers, business affiliates and credit reporting agencies.

  3. Who is this information shared with?

    Selz may share your personal information with a variety of third parties under the following circumstances:

    1. To prevent, investigate, or take action regarding illegal activities, suspected fraud or unlawful activity, violations of our Terms of Service, or any other agreements related to the Services;
    2. Service providers: we may share your personal information with service providers who perform services on our behalf, such as providing marketing and/or advertising campaigns, security and IT management, hosting, and for processing secure payments, fulfilling orders, and optimizing our services;
    3. Where required by law: we may share your personal information with  law enforcement agencies, courts, other governmental authorities or other third parties where we believe this is necessary to comply with legal or regulatory obligations, or otherwise to protect our rights or the rights of any third party;
    4. Restructuring: we may share your personal information with another company if it acquires our business, whether through merger, acquisition, bankruptcy, dissolution, reorganization, or other similar transaction or proceeding. If this happens, we will take appropriate steps to inform you, including sending you an email, if we have your email address, and posting notices on our home page.
    5. Unless your data can be shared on the basis of other lawful grounds under applicable law, and other than as set out in Section 7 (Third Party Apps), Selz will always ask for your consent before sharing your personal information with third parties.

3. Information relating to our Buyers

  1. What information do we collect from Buyers?

    1. Usage data: we collect information about orders that Buyers initiate, information about the Selz-supported stores that Buyers visit, and information about the device and browser they use. 
    2. Checkout data: we collect our Buyers’ name, email, shipping address, billing address, phone number, IP address, and any other custom fields as defined by our Merchants.

    We use this information to provide our Merchants with the Services, including supporting and processing orders, for risk and fraud screening, and authentication purposes.

  2. How is this information collected?

    We collect this information when a Buyer uses or accesses an online store or online checkout that uses our Services, such as when a Buyer visits a Merchant’s site, or places an order on a Merchant’s site. We may also collect personal information from third parties, such as our service providers, and business affiliates.

  3. Who is this information shared with?

    Selz may share your personal information with a variety of third parties under the following circumstances:

    1. To prevent, investigate, or take action regarding illegal activities, suspected fraud or unlawful activity, violations of our Terms of Service, or any other agreements related to the Services;
    2. If the Merchant whose store you visit or whose checkout you access directs us to transfer this information;
    3. Where required by law: we may share your personal information with  law enforcement agencies, courts, other governmental authorities or other third parties where we believe this is necessary to comply with legal or regulatory obligations, or otherwise to protect our rights or the rights of any third party;
    4. Restructuring: we may share your personal information with another company if it acquires our business, whether through merger, acquisition, bankruptcy, dissolution, reorganization, or other similar transaction or proceeding. If this happens, we will take appropriate steps to inform you, including sending you an email, if we have your email address, and posting notices on our home page.

This section and all related provisions of this Privacy Policy do not apply to you if your personal information is subject to European or UK data protection law. This is because we only process such information as a processor on behalf of Merchants, and so if you have any questions about the processing of such personal information, please contact the Merchants you have been dealing with.

4. Information relating to Leads

  1. What information do we collect from Leads?

    We collect your email address along with the details of your city and country. We use this information to deal with your enquiries and requests, to provide you with pre-sales support and to contact you with marketing and advertising, including through our newsletter, and offers relating to our Services. 

  2. How is this information collected?

    We collect this information if you visit the Selz website and express an interest  in our Services or sign-up to our marketing materials, such as our newsletter.

  3. Who is this information shared with?

    Selz may share this information with a variety of third parties under the following circumstances:

    1. To deal with your enquiries and requests through online chat and email;
    2. Service providers and business partners and advertising partners: we may share your personal information with service providers and partner companies who perform services on our behalf, such as providing marketing and/or advertising campaigns, security and IT management, hosting, and for processing secure payments, fulfilling orders, and optimizing our services;
    3. Where required by law: we may share your personal information with  law enforcement agencies, courts, other governmental authorities or other third parties where we believe this is necessary to comply with legal or regulatory obligations, or otherwise to protect our rights or the rights of any third party;
    4. 5. Information relating to Selz Website Visitors and Support Users

  1. What information do we collect from Website Visitors and Support Users?

    1. Website visitors: we collect information about the device and browser visitors use, as well as the visitors’ network connection, IP address, operating system, device type, pages visited, time spent on page and information about the cookies installed on your device.
    2. Support Users: we collect chat support users’ name, email address, information about the device and browser you use, your network connection, IP address, chat transcript and other personal information you provide during the chat.

    We use this information to verify your account, to provide and enhance our Services and answer any questions you may have, and contact you with marketing including through our newsletter, and offers relating to our Services.

  2. How is this information collected?

    We collect this information if you visit the Selz website, use the Services offered on our website or engage with us either by email, web form, or instant message.

  3. Who is this information shared with?

    Selz may share your personal information with a variety of third parties under the following circumstances:

Service providers and business partners: we may share your personal information with service providers and partner companies who perform services on our behalf, such as providing marketing and/or advertising campaigns, security and IT management, hosting, and for processing secure payments, fulfilling orders, and optimizing our services;

As part of offering and providing customizable and personalized services, we use cookies to store and sometimes track information about your use of this site (such as your preferences, session information and information on how you visit and access our web pages). 7. Third Party apps

Selz’s platform allows merchants to connect their stores with third party applications to alter or provide new functionalities in their store. Selz is not responsible for and has no control over how these apps function. Merchants ultimately can control which apps they choose to use with their stores, and are responsible for making sure that they do so in compliance with relevant privacy and data protection requirements.

8. Account closure and your personal data

We will retain your personal information for a period of time that enables us to continue to provide a service to you, for example:

  • Deal with any complaints regarding the services
  • Defend or bring any existing or potential legal claims
  • Comply with record retention requirements under the law, and our company record retention policies
  • To meet our legal obligations including financial/accounting/tax obligations 
  • Maintain business records for analysis and/or audit purposes 

We will delete your personal information when it is no longer required for these purposes, and in response to a valid erasure request. If there is any information that we are unable, for technical reasons, to delete entirely from our systems, we will put in place appropriate measures to prevent any further processing or use of the information.

9. How we store and secure your personal information

We follow industry standards on information security management to safeguard your personal information, including, employee details and any other personal information entrusted to us. Our information security systems apply to people, processes and information technology systems on a risk management basis.

No method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, we cannot guarantee the absolute security of your personal information.

10. Access, corrections, complaints and further information

Where applicable law provides a right to access your personal information held by Selz or to request an amendment or correction of your personal information, you may contact Selz using the contact details below to do so. 

Your request should provide as much detail as possible to assist us to identify information relevant to you, such as your name and contact details, any former names and the information you believe Selz may hold about you. You do not have to provide a reason for requesting access. Where Selz holds information that you are entitled to access, we will endeavour to provide you with a suitable range of choices as to how you may access it (e.g. emailing or mailing it to you).  

If you believe that personal information Selz holds about you is incorrect, incomplete or inaccurate, then you may request we amend it. We will consider if the information requires amendment. If Selz does not agree that there are grounds for amendment, then we will add a note to the personal information we hold stating that you disagree with it.

Any questions about this policy, or any complaint regarding treatment of your privacy by Selz, should be made through the contact details below.

If required by applicable law, Selz will acknowledge receipt of your request or complaint within a reasonable period and in any event within 10 working days and endeavour to respond to your request within 30 days.

11. Mandatory data breach reporting

If, for any reason, the security of your personal information is potentially compromised due to a data breach and the processing of your personal information is subject to Australian data protection law:

  1.  Selz may report the breach to third parties such as government agencies, police or law enforcement bodies, insurance providers or financial services providers or as required by law. 
  2. Provided Selz have your contact details, Selz will notify you if you have been personally impacted by a notifiable data breach.  

12. UK and European Data Protection Law 

  1. What rights do you have under UK and European data protection law?

    If you are located in the European Economic Area (EEA) or the United Kingdom, you have certain rights under local data protection law with respect to your personal information, including the right to request access to, correct, rectify, delete, object to, and restrict the use of your personal information, as well as receive your personal information in a useable electronic format and transmit it to a third party. 

    If you are a Merchant, Website Visitor, Lead, or Support User and wish to exercise these rights, please reach out to us using the contact information below. If you are a Buyer and wish to exercise such rights, please contact the Merchants you interacted with directly - we serve as a processor on their behalf, and can only forward your request to them to allow them to respond.

    We encourage you to contact us to update or correct your information if it changes or if the personal information we hold about you is inaccurate. 

    We will contact you if we need additional information from you in order to honour your requests.

    We are committed to working with you to obtain a fair resolution of any complaint or concern about privacy. If, however, you have unresolved concerns, you may have the right to complain to your local data protection authority.

  2. What lawful bases do we rely upon to process your personal information under UK and European data protection law?

    We must have a legal basis to process your personal information. In most cases the legal basis will be one of the following:

    1. to fulfil our contractual obligations with you (for example if you make an order through the site, to provide our Services or to ensure that invoices are paid correctly); 
    2. to comply with our legal obligations, for example to respond to requests from law enforcement agencies;
    3. to meet our legitimate interests, for example to understand how you use our Services and to enable us to derive knowledge from that to enable us to develop new services. When we process personal information to meet our legitimate interests, we put in place robust safeguards to ensure that your privacy is protected and to ensure that your interests or fundamental rights and freedoms are not overridden by our legitimate interests.

    We may obtain your consent to collect and use certain types of personal information when we are required to do so by law (for example, for sending marketing material such as newsletters). 13. How we transfer information we collect internationally

Selz works with merchants and users around the world. We collect information globally and primarily store that information in the United States. We transfer, process and store your information outside of your country of residence, to wherever we or our third-party service providers operate for the purpose of providing you the Services. Whenever we transfer your information, we take steps to protect it, however these countries may not have adequate privacy and data protection laws.

If you are located in the EEA or United Kingdom, as part of our Service, we may transfer your personal information to other regions, including to Australia, the United States and The Philippines. In order to ensure that your information is protected when transferred out of the EEA, Selz has put in place appropriate safeguards (such as contractual commitments) in accordance with applicable legal requirements to provide adequate protections for your personal information. 14. Our policy towards children

The Services are not directed to individuals under 16. We do not knowingly collect personal information from children under 16. If we become aware that a child under 16 has provided us with personal information, we will take steps to delete such information. If you become aware that a child has provided us with personal information, please contact our support services.

15. Changes to our Privacy Policy

We may change this privacy policy from time to time. We will post privacy policy changes on this page and, if the changes are significant, we will provide a more prominent notice by adding a notice on the Services homepages, login screens, or by sending you an email notification. We will also keep prior versions of this Privacy Policy in an archive for your review. We encourage you to review our privacy policy whenever you use the Services to stay informed about our information practices and the ways you can help protect your privacy.
